2. Learned Counsel for the parties agree that this application will have to be allowed and an Arbitrator will have to be appointed to adjudicate upon the disputes which have arisen between the parties.

3. Accordingly. Hon'ble Shri Justice F. M. Reis, Retired Judge of this Court, is appointed as an Arbitrator.

4. Learned Counsel for the parties state that necessary declaration under Section 12 of the Arbitration and Conciliation Act, 1996, would 8th December, 2023

AAR 8 of 2023 be filed by Hon'ble Shri Justice F. M. Reis, within 15 days from today.

5. Learned Counsel for the parties state that the Arbitrator's fees would be paid in terms of the Schedule to the Arbitration and Conciliation Act, 1996.

6. Application stands disposed of.
