Heard Mr. Shivan Desai, learned Advocate appearing for the petitioner and Mr. A. N. S. Nadkarni, learned Advocate General appearing for the respondents.
2. The grievance of the petitioner is that despite of registering FIR, the investigation is not in progress. But however, Mr. Nadkarni, learned Advocate General points out that the investigation is in progress and in fact some statements are already been recorded. Mr. Nadkarni states that report under Section 173(1) of CR.P.C. shall be filed within a period of six weeks. Said statement is accepted.
3. Mr. Desai, learned counsel appearing for the petitioner upon instructions seeks leave to withdraw the above petition, in view of the acceptance of said statement.
