2. i have considered the grounds urged in the application which was supported by an affidavit and not being seriously controverted by the respondents. Otherwise, in the exercise of the powers conferred under Section 407(1)(C)(ii), there are ample powers in this Court to allow the said application. The grounds urged was that the matter was substantially argued before the Sessions Judge as the then Additional Sessions Judge. It is a fairly reasonable ground urged on behalf of the appellant to support his case for the transfer. It is otherwise the contention

CRXFA/1/2018 of Shri Amonkar, learned Counsel for the applicant that the learned Counsel who argued the matter was not keeping good health and will not be possible to canvas the case on behalf of the petitioner.

3. Considering the totality of the facts and circumstances of the case and no prejudice would be caused to the petitioner, i allow the application.

4. Parties are to appear before the learned Sessions Judge on 14/03/2018.
