This is an application for suspension of execution of sentence passed by the learned JMFC in criminal case No.48/S/2012 of the offences punishable under Sections 279, 338 and 304-A of IPC.
2. The petitioner has been convicted for the offence punishable under Section 279 of IPC and sentenced to suffer simple imprisonment for six months.
(ii) He has been convicted for the offence punishable under Section 304-A of IPC and sentenced to suffer simple imprisonment for one year and payment of fine of Rs.3000/- and
CRMA/255/2017 (iii) He has been convicted for the offence punishable under Section 338 of IPC and sentenced to suffer simple imprisonment for six months and payment of fine of Rs.1000/- (iv) And further directed to pay compensation of Rs.30,000/-.
3. It is submitted by the learned Counsel for the petitioner that the petitioner was on bail throughout and has already deposited the amount of compensation. On instructions, he undertakes to deposit fine amount within one week. The statement is accepted.
4. Learned Public Prosecutor has no objection in releasing the petitioner on bail.
5. As such, pending the Revision Petition, petitioner be released on executing a fresh bail bond in the sum of Rs.10,000/- with one or two sureties in the like amount. It is made clear that the release of the petitioner on bail would be subject to deposit of fine amount before the Sessions Court. The petitioner shall furnish his bail bond before Court of Additional Sessions Judge.
6. Application stands disposed of.
