Heard Mr. D. Basu, learned counsel appearing for the petitioners, Mr. P. A. Kamat, learned counsel appearing for the respondent no.2 and Mr. S. Rebello, learned Addl. Government Advocate appearing for the respondent nos.3 to 6.
2. After hearing the matter for some time, Mr. Basu, learned counsel appearing for the petitioners upon instructions of the petitioners seeks leave to withdraw the above Writ Petition in case this Court is inclined to direct the expeditious disposal of Special Civil Suit No. 134/2007 pending before the learned Civil Judge Senior Division, Mapusa. The learned counsel further pointed out that the dispute is with regard to the access which is necessary
WP/770/2014 considering that the petitioner no.1 is a senior citizen.
3. In the facts and circumstances of the case, the above petition stands dismissed as withdrawn.
4. The learned Civil Judge Senior Division, Mapusa, is directed to dispose of Special Civil Suit No. 134/2007 as expeditiously as possible and in any event within one year from the date of the receipt of this Order. All contentions of the petitioners are left open. K. L. WADANE, J.
