This is an application by the applicant/ appellant for withdrawal of the appeal.

2. Shri Menezes, the learned Counsel for the applicant states that he has apprised the applicant about the consequences of withdrawal of appeal. However, the applicant is still insisting for the appeal being withdrawn.

3. The applicant is produced before the Court today. I have verified the contents of the application and the intention of the applicant to withdraw the appeal and the applicant, in categorical

CRMA/98/2017 terms, states that he is not interested in prosecuting the appeal.

4. In the given circumstances, there is no option except to permit withdrawal of the appeal. Consequently, the application is allowed. Criminal Appeal no.44/2015 is disposed of as withdrawn.
