Heard Shri Shaikh Mujahidin Ismail, the learned Counsel for the applicants.

By this application under Section 389 Cr.P.C., he has prayed for suspension of the sentence pending the appeal, passed by the learned Additional Sessions Judge, Panaji on 02/08/2019. The applicants have been convicted and sentenced to undergo simple imprisonment for six months and fine of ₹5,000/-, in default simple imprisonment for three months of an offence punishable under Section 306 read with 34 IPC.

It is submitted that the applicants have good case on merits. The applicants were on bail during the course of the trial before the Additional Sessions Judge.

Mr. Pravin Faledessai, the learned Additional Public Prosecutor for the respondents has no objection.

As such, pending the hearing and disposal of the appeal, the applicants be enlarged on furnishing fresh bail bond in the sum of ₹10,000/- with one surety in the like amount to the satisfaction of the Registrar (Judicial). The applicants shall attend the Court as and when directed.
