Mr. Vernekar, on instructions seeks leave to withdraw this petition with liberty to challenge the impugned order in case the appeal before the First Appellate Court is ultimately decided against the Petitioner and the Petitioner chooses to institute a Second Appeal to question the same.

He submits that this request is in terms of Section 105 of CPC.

Since, this request is quite reasonable there can be no difficulty in granting the same. Accordingly, this petition is disposed of as withdrawn with liberty as prayed for.
