The applicant has been convicted for the offence punishable under Section 279 and 304-A of IPC. For the offence under Section 279 of IPC, the applicant has been sentenced to undergo simple imprisonment for a period of six months and under Section 304-A, the applicant has been sentenced to suffer imprisonment for two years. The applicant has also been directed to pay total fine of Rs.10,000/- and in default to suffer simple imprisonment for a period of eight months. The said judgment of conviction and sentence has been confirmed in appeal. The revision application filed by the applicant has been admitted. The applicant was all along on bail during the course of the trial before the Magistrate and the appeal before the learned Sessions Judge. In such circumstances, the
CRMA/201/2016 following order is passed:
O R D E R
(i) The substantive sentence of imprisonment is hereby suspended till the disposal of the Criminal Revision Application on condition of the applicant furnishing a PR bond in the sum of Rs.15,000/- with one solvent surety in the like amount.
(ii) The applicant shall deposit the amount of fine before the learned Sessions Judge.
(iii) Bail bonds to be furnished before the learned Sessions Judge. C. V. BHADANG, J.
