Mr Ajit Kantak appears for the appellant along with Mr Bicu Narayan Vaigankar, duly constituted attorney of the appellants, Mr V. Sardessai, learned Additional Government Advocate for respondent no.1 who is a formal party and Mr Santosh Bharne appears along with Mr Sadashiv Gaonkar, Executive Engineer, Goa Housing Board who has been duly authorized to act on behalf of respondent no.2 in the present proceedings.

Learned counsel appearing for the appellant and respondent no.2 states that the parties have agreed to settle the matter by enhancing the compensation to Rs.42/- per sq.mtr. as against Rs.35/- per sq.mtr. granted by the Reference Court. The minutes of the consent terms duly signed by the appellant and respondent no.2 identiDed by the respective advocates are taken on record and marked 'X' for identiDcation.

Letter of authority issued by the Goa Housing Board is taken on record and marked as 'Y' for identiDcation.

Award in terms of the consent terms Dled.

It is agreed by both the parties that the initial compensation granted by the Reference Court @ Rs.35/- per sq.mtr. has been already paid by respondent no.2 to the appellant. Hence, respondent no.2 shall

pay the balance compensation of the amount @ Rs.7/- per sq.mtr. along with all statutory beneDts under the Land Acquisition Act, 1894 to the appellants within a period of two months.

The appeal stands disposed of.
