Mr Padiyar, on instructions, states that in so far as repairs to the existing house by plastering the walls with cement plaster and providing tiles to the flooring of the hall are concerned, MMC will take no further action. Accordingly, this statement is recorded and the MMC is directed not to take any further action regards the plastering and the tiling to the existing house shown in colour green in the document of transgression.

Mr Usgaonkar, the learned Senior Advocate for the petitioner, based on instructions from the petitioner Dattaram Govekar, who is present in Court, seeks leave to withdraw the petition. Mr Usgaonkar states that the RCC pillars in colour yellow on transgression plan have already been removed by the petitioner.

Accordingly, after recording Mr Padiyar's statement, this petition is permitted to be withdrawn. The petition is disposed of accordingly.
