The learned Central Government Standing Counsel seeks leave to withdraw the criminal revision application as the petitioner intends to approach the learned Sessions Judge by filing criminal revision application. He submits that the matter before the learned Magistrate is fixed on 10.10.2016 and as such, the petitioner may be protected for limited period.

2. In such circumstances, the criminal revision application is disposed of as withdrawn.

3. There shall be ad-interim stay of the trial before the Magistrate for a period of two weeks, in order to enable the petitioner to approach the Sessions Judge. It is made clear that this Court has not expressed any opinion on merits.
