Considering the manner in which the order has been passed and in the interest of justice, the impugned order is set aside. The matter is remanded to the learned Judicial Magistrate First Class 'D' Court, Panaji-Goa, to deal with the application appropriately.

The petitioner is directed to deposit an amount of ₹2,000/- in the Goa State Legal Services Authority within two weeks from today. The parties are directed to appear before the Judicial Magistrate First Class 'D' Court, Panaji on 12/11/2018 at 10.00
