IN THE HIGH COURT OF BOMBAY AT GOA

WRIT PETITION NO. 875 OF 2015 SHASHIKANT NARAYAN JOSHI AND ANR., ... Petitioners

Versus

STATE OF GOA, THROUGH ITS CHIEF SECRETARY AND 2 ORS., ... Respondents Mr. A. D. Bhobe and Ms. Archana Sachin Pai Bir, Advocates for the petitioners.

Mr. V. Rodrigues, Government Advocate for the respondents. Coram:- F. M. REIS & K. L. WADANE, JJ.

Date:- 13th January, 2016 P.C.

Heard Mr. A. D. Bhobe, learned counsel appearing for the petitioners and Mr. V. Rodrigues, learned Government Advocate appearing for the respondents.

2. Mr. A. D. Bhobe, the learned counsel appearing for the petitioners submits that the petitioners are forced to approach this Court as it was contended by the Director of the Land Survey that he has no powers to decide the application filed in terms of Article 72 of Decree 3602.

3. Upon hearing the learned counsel, the only point for consideration is that the application filed by the petitioners in terms of Article 72 of Decree 3602 is pending consideration before the

WP/875/2015 competent authority for the last more than six months.

4. Mr. V. Rodrigues, learned Government Advocate points out that such application shall be disposed of as expeditiously as possible in terms of the relevant provisions of law. Hence, we accordingly direct the competent authority in terms of the Article 72 of the said Decree 3602 to take a decision on the application filed by the petitioners as expeditiously as possible within six months from today. All contentions of the parties on merits are left open. The petition stands disposed of accordingly.
