1. Heard Ms Kamat, the learned Additional Government Advocate for the Applicant/Appellant State of Goa and the Executive Engineer, Works Division, PWD, who seek condonation of delay of 231 days in filing the First Appeal.

2. I have perused the application and heard Ms Kamat. The application in great detail, has set out the reasons why the Appeal could not be filed within the period of limitation and considering the fact that the Appellant is a Government and it involve moving of the file from one desk to another and from one Officer to other and since the application specifically set out the procedure being 17th October, 2025

MCA 26 of 2024 followed in that regard in paragraph 7, being convinced by the bonafides of the justification being offered, I deem it appropriate to grant the application by condoning the delay of 231 days in filing the First Appeal.

List the First Appeal for hearing on 07.11.2025. BHARATI DANGRE, J.
