This petition can be disposed of on a short point. The petitioner feeling aggrieved by the order dated 02/07/2019 passed by the 3rd respondent- Block Development Officer refusing to grant the NOC for the purpose of carrying out repairs to the dwelling house bearing House No.120 has approached this Court.

2. We have heard the learned Counsel for the parties.

3. The learned Advocate General states that the NOC is refused on the basis of the report made by the Block Development Officer upon visit to the said house. He further submits that the Block Development Officer would conduct a fresh inspection of the said house in the presence of the petitioner and the respondent No.5 and shall decide the application for grant of NOC afresh after hearing the petitioner and the respondent No.5 in accordance with law, within six weeks from today. The statement so made is accepted.

4. The petition is disposed of in the aforesaid terms, with no order as to costs.
