2. Mr. Desai, the learned Counsel for the appellant, on instructions, states that the suit premises have not been transferred to any third party and the appellant continues to be in possession of the suit premises as on today.
3. There shall be interim stay in terms of prayer clause (a) during the pendency of the appeal, subject to the appellant not creating any third party interest or parting with possession of the
