The learned Counsel for the appellant, on instructions, seeks leave to withdraw the appeal as the appellant intends to approach the learned Arbitrator with an application under Section 17 of the Arbitration and Conciliation Act.

2. In such circumstances, the appeal is disposed of as withdrawn. Needless to mention that if an application under Section 17 is filed before the learned Arbitrator, the learned Arbitrator shall decide the same on its own merits and without being influenced by the observations or the findings of the learned District Judge.
