The main grievance raised by the petitioner is that the learned Judge, whilst condoning the delay of 8 days, did not examine the maintainability of the challenge to the ex parte decree in the Misc. Civil Appeal filed by the respondents.

2. Keeping this contention open to be examined by the learned Judge at the appropriate stage, the petition stands disposed off, with liberty to the petitioner to challenge impugned order, if any, adverse is passed at the time of the final disposal of the appeal. F. M. REIS, J.
