This is an application for condonation of delay in filing an application for leave to appeal against acquittal. The respondent is absent though served.

2. There is 139 days delay, the reason being that earlier mistakenly the application was filed before the learned Sessions Judge and after that the learned Counsel previously appearing for the applicant had taken ill.

3. Considering the reasons as mentioned in the application the same is allowed. The delay is condoned. Let the Criminal Application be registered. The Criminal Application be listed for admission on 7/03/2017.
