Mr. P. S. Lotlikar, learned counsel appearing for the petitioner seeks discharge, as according to him, he has given withdrawal notice to the petitioner. Request granted.

3. Mr. Borkar, learned counsel for the petitioner alongwith the petitioner are present in the Court and have filed a memo duly signed by the petitioner stating that the petitioner no longer desires to proceed with the above Writ Petition and seeks leave to withdraw the Writ Petition unconditionally.

4. Mr. Desai, learned counsel appearing for the applicant in MCA No. 490/2015 submits that applicant therein desires to intervene in the above Writ petition.

5. Considering that the petitioner desires to withdraw the above Writ Petition unconditionally, we permit the petitioner to withdraw accordingly.

6. Applicant, if so advised, may file an appropriate proceeding by raising all the contentions raised in the above Writ Petition in accordance with law as we have not examined the merits of the contentions raised in the above Writ Petition.

7. Keeping all the contentions of the intervenor open, petition stands dismissed as withdrawn with liberty as stated herein.
