Mr. Ganesh Naik submits that in this case, the Applicant has already filed a cross complaint against some persons. He submits that the Applicant was himself assaulted and thereafter, admitted in the hospital. Accordingly, he submits that this is a fit case for grant of an interim bail.

The charge against the Applicant is quite serious and the provisions of Sections 324 and 307 of the Indian Penal Code have been invoked. In a matter of this nature, a custodial interrogation is necessary, particularly, since, the weapons of assault are required to be recovered. Besides, as observed by the Sessions Court, the Applicant
2 crmab263-19-29-10-19 and the victims are from the same locality and the issues of law and order are also likely to arise.

The circumstance that even the applicant has lodged a cross complaint has been taken into consideration.

Accordingly, no case is made out for grant of an anticipatory bail.

The Application is, therefore, rejected.
