Coram : N.M. Jamdar & Prithviraj K. Chavan, JJ.
Date : 29 October 2018.
P.C.:
This Application is filed for clarification in respect of the order passed by us on 16 July 2018.
2.
The learned Senior Advocate appearing for the Applicants-original Petitioners submitted that the last line of paragraph 2 of the order gives an impression that the Applicantsoriginal Petitioners have given up the wider issues. However, we
2 mca836-18dt29-10-18 have already recorded in the order dated 15 June 2018 that the Petitioners had submitted that apart form the wider issues there were some lesser issues. In view of the submission made by the learned Advocate General, the Petitioners did not urge wider issues and were satisfied with the resolution of dispute on the lesser grounds at that stage.
3.
Therefore, in view of this position, the last part of the third line in paragraph 2 "nor any wider issues have been raised by the Petitioner" should be read in the context of the submission made by the learned Advocate General, and not to be considered that the Petitioners had given up the wider issues. Order dated 16 July 2018 to be read accordingly.
