Heard Ms Kamat for the Petitioners and the learned Additional Government Advocate, Mr Deep Shirodkar for Respondent Nos. 1 and 2.

2. Ms Kamat points out that the challenge to this Petition was to the Shack Policy, 2019. This Policy was valid up to 31.05.2023. Accordingly, the relief in this Petition has been rendered infructuous.

3. Ms Kamat, however, points out that an issue was raised about the allotment of Shacks through public auction.

4. Accordingly, while disposing of this Petition as infructuous, we clarify that this particular issue is kept open to be decided in an appropriate case.

5. Accordingly, this Petition is disposed of by keeping open the issue of allotment of Shacks by public auction. There shall be no order as to costs.
