Learned Advocate for the Applicant submits that Criminal Case (NDPS) No.41/2022 on the file of the District Judge 1 and Additional Sessions Judge, Mapusa, from which the present petition arises, has been listed for Arguments before Charge on 19.08.2025. He submits that the Applicant would proceed to argue the matter before framing charge and in the event the Applicant is discharged, the present petition would obviously not lie. On instructions, he seeks to withdraw this petition with liberty to file a fresh petition pressing for the same reliefs in the event that he is not discharged in the aforementioned case.
