During the course of the hearing of the above petition, Mr. S. Desai, learned counsel appearing for the petitioner upon instruction points out that the subject construction has already been demolished by the competent authority under a different statute and as such the petitioner does not want to proceed with the challenge in the above petition.

2. In view of the above statement, the challenge to the provisions in the present petition would no longer survive. The petition stands accordingly dismissed as infructuous. K. L. WADANE, J.
