The learned counsel for the petitioner seeks leave to withdraw the petition with liberty to challenge the impugned order in appeal under Article 1435 of the Portuguese Civil Procedure Code and/or under Section 451 of the Goa Succession, Special Notaries and Inventory Proceeding Act, 2012 before the learned District Judge. He submits that he be protected on limitation. In such circumstances, the petition is disposed of as withdrawn with liberty as prayed. Needless to mention that if such an appeal is filed along with an application for condonation of delay, the learned District Judge shall have due regard to the provisions of section 5 and section 14 of the Limitation Act.
