OPERATIVE PART (i) Criminal Revision Application is partly allowed. (ii) The impugned order is hereby set aside. (iii) The learned Special Judge shall permit the petitioner to examine Stalin Jadhav as a defence witness on a date to be fixed by the learned Special Judge.

(iv) The petitioner shall keep the said witness present along with necessary certificate under Section 65-B of the Indian Evidence Act.

(v) No further adjournment shall be sought. (vi) All rival contentions are left open.
