Heard Mr. A. D. Bhobe, learned counsel for the Petitioner, Mr. G. Nagvenker, learned Additional Public Prosecutor for Respondent No.1 and Mr. S. Sardessai, learned counsel for Respondent No.2. 2.

The learned Additional Public Prosecutor makes a statement that "A" Summery report has already filed before the competent Court. 3.

Mr. Sardessai, learned counsel for Respondent No.2 ( Complainant ) states that a protest application has also been filed before the competent Court.

According to us, the competent Court to dispose off the proceedings before it as expeditiously as possible. 5.

Since, "A" Summery report has already filed, there is no necessity to keep this petition pending. However, if any orders adversed to the interest of the Petitioner are made by the competent Court, then, we grant the Petitioner liberty to file a fresh petition seeking quashing of FIR.

All contentions of parties are expressly left open since we have not adverted to the merits of the rival contentions. 7.

The petition is disposed off. There shall be no order as to costs.
