ORAL JUDGMENT (Per R. D. Dhanuka, J.) The learned Counsel for the respondent nos.2 and 3 tenders an

-- 2 -- affidavit in reply dated 10.1.2019 and submits that his client has received information from the Employees Provident Fund Commissioner (Pension) Regional Office Goa, stating that pension of the Petitioner was released from 10.10.2017 and has been continuously receiving the said pension w.e.f. 19.10.2017.

The learned Counsel appearing for the petitioner does not dispute this position. Affidavit is taken on record. 3.

In view of the statement made by the respondent nos.2 and 3 in the affidavit and confirmed by the learned Counsel for the petitioner, nothing survives in this petition and same is accordingly disposed of. In the event of petitioner not getting pension in future what petitioner is entitled to, the petitioner would be at liberty to file appropriate proceedings.
