The petition is being adjourned since 1 February 2017 for the purpose of settlement. After long deliberation, the Petitioner and Respondent No.2 have tendered the consent terms.

2. The learned counsel for Respondent No.2 states that the consent terms have been signed by the Secretary of the Devasthan on behalf of the Devasthan who has been authorized by the resolution passed by the Devasthan. He states that the copy of the resolution will be placed on record. This statement is accepted. It appears that the Petitioner and Respondent No.2 have agreed for certain arrangement between themselves

WP/1026/2016 regarding the property in question.

The Respondent No.1-Municipal Corporation is not a party to the consent terms. The learned Senior Advocate for the Petitioner and the learned counsel for Respondent No.2 state that in these consent terms there is nothing that will affect the Municipal Corporation.

3. In view of the consent terms executed between the Petitioner and Respondent No.2 which have been taken on record and marked 'X', nothing further survives to be adjudicated in this petition since the consent terms so placed on record will bind the Petitioner and Respondent No.2. The Writ Petition is disposed of.
