Heard Shri S.M. Singbal, the learned Counsel appearing for the petitioner and Shri Shivan Desai, the learned Counsel appearing for the respondents.

2. This is a Writ Petition challenging the order passed by the learned Civil Judge, Junior Division, Mapusa dated 24/08/2015 by which the relief of temporary injunction in terms of prayer clause 'a' has been granted, as the learned advocate appearing for the respondent/defendant retired from the proceedings.

3. Perused the record and the order under challenge, from which it is seen that the interim relief is granted till the disposal of the temporary injunction application. In such circumstances, the Writ Petition can be disposed of by giving following directions to the learned Trial

WP/856/2015 Court:

(i) The learned Trial Court shall dispose of the temporary injunction application within a period of six weeks from the date of the communication of this order.

(ii) The learned Trial Court shall dispose of the Writ Petition on its own merits.

(iii) The contentions of the parties are left open.

4. Without going into the merits of the Writ Petition, this Writ Petition is disposed of with the above directions. K. L. WADANE, J.
