It is made clear that the pendency of this appeal shall not be a bar for the trial court to proceed with the suit. In fact, the trial court should proceed with the suit and endeavour to dispose of the same on merits without in any manner being influenced by the impugned order or the fact that this appeal is pending.

The Civil Application seeking interim reliefs is disposed of since, by the impugned order interim relief was declined by the appellant and, further, it is not as if any ad-interim order was operating during the pendency of the application for interim relief before the trial court. M. S. SONAK, J.
