Heard the applicant in person, Mr. S. G. Desai, learned Senior Counsel appearing for the respondent no.1 and Mr. P. Faldessai, learned Addl. Government Advocate appearing for the respondent no.2.

2. This is an application to recall an order passed on 01.08.2016 based on the statement recorded of the learned Additional Advocate General. It is the contention of the applicant that such statement was recorded contrary to the records of the

MCA/856/2016 State Government. This aspect is disputed by the learned Addl. Government Advocate appearing for the respondent no.2.

3. Be that as it may, admittedly the applicant was not a party to the above petition. The grievances of the applicant on the basis of the allegations made in the application are left open which the applicant can raise before an appropriate authority or in any proceedings in accordance with law.

4. With the above observations, the application stands disposed of accordingly.
