The application seeks condonation of delay of 128 days in filing the First Appeal.

2. Heard learned counsel for the applicants and I have perused the application filed under Section 5 of the Limitation Act, 1963.

3. On its perusal, since it is noted that the delay is not malafide and has sufficiently explained, I am inclined to condone the delay since the grounds of medical illness which are stated in the application appear to be bonafide.
