Heard Shri S. Mahambrey, learned Advocate for the petitioners and Ms. P. Kamat, learned Addl. Govt. Advocate for the respondent.
2. Upon hearing the learned Counsels, the main grievance of the petitioners is that the petitioners cannot be personally made liable to the penalty claimed by the respondent which was imposed on the deceased father of the petitioner.
3. Ms. P. Kamat, learned Addl. Govt. Advocate has taken me through the order passed by the learned Tribunal to point out that it has been clearly observed that the recovery as against the legal representatives of the deceased defaulter would be to the extent of the properties inherited by the petitioners from the deceased defaulter and not from their personal assets.
4. In view of the said statement of the learned Counsel appearing for the respondent which basically clears the apprehension of the
WP/92/2016 petitioners, I find that, nothing survives in the above petition, which stands accordingly dismissed.
