The challenge in the above petition is to an order passed by the learned Tribunal inter alia holding that the Revision Application filed by the petitioner is not maintainable relying upon the judgment passed by this Court. The order under challenge were in the course of proceedings filed by the petitioner to register himself as a mundkar.

2. In such circumstances, looking into the effect of such order, there will be no failure of justice, in case the impugned order is allowed to stand.

3. It is pointed out by the learned Counsel appearing for the petitioner that in the meanwhile the petitioner has also filed an application for declaration under Section 8(A) of the Mundkar Act.

4. In such circumstances, I find that there is no case made out for interference in the impugned order. Needless to say that the application, if any, filed by the petitioner, the same shall be examined

WP/1058/2016 by the learned Mamlatdar on its own merits and in accordance with law.
