By this petition, the petitioners/original accused are challenging the judgment and order dated 20/8/2017 passed by the learned Sessions Judge, by which, the learned Sessions Judge has confirmed the order dated 10/3/2017 below (Exhibit 159) passed by the learned Magistrate, whereby the application filed by the first respondent/complainant under section 319 of Cr.P.C for addition of the petitioners as accused has been allowed.

2. The parties have reached an amicable settlement and have filed Minutes of Order, which are taken on record and marked "X" for identification.

3. I have heard the learned counsel for the parties.

It appears that apart from the complaint under section 138 of the Negotiable Instruments Act, filed by the first respondent, there is also a private complaint case filed by the respondent no.2 against the respondent no.1. The parties submit that they will withdraw their complaints pending before the learned Magistrate unconditionally. The statement is accepted.

5. Needless to mention that, if such a request for withdrawal is made, the learned magistrate shall pass appropriate orders permitting withdrawal of the complaints.

6. In that view of the matter, nothing survives in the matter, which is disposed off.
