Considering the averments made in the Civil Application and the fact that the estate was well represented, this Civil Application is made absolute in terms of prayer clauses (a) and (b), which read as follows :

"a) That this Hon. Court be pleased condone the delay of 730 days that has occurred in filing an application to implead the legal representatives of deceased Appellant No. 2, other than Applicant No. 1, who is already a party to the aforesaid second appeal; and, b) That this Hon. Court be pleased to permit the aforesaid 23/02/23

29-MCA-71-23.DOC legal representatives of deceased Appellant No. 2 to be impleaded as legal representatives of deceased Appellant No. 2, i.e., as Appellant Nos. 2(a), 2(b), 2(c), 2(d), 2(e) and 2(f), respectively, and to permit the necessary amendment to the cause title of the memorandum of the aforesaid second appeal to be carried out.

Mr Menezes states that necessary amendment will be carried out within two weeks from today. He states that he will appear on behalf of the LRs of the deceased Appellant No.2, who are now brought on record.
