This is an application seeking bail at the stage, when trial before the learned Sessions Judge, is part heard.

2. I have heard the applicant in person and Shri Vaz, the learned Special Public Prosecutor for the respondent.

3. It transpired during the course of argument at bar that only the Investigating Officer and one panch witness remain to be examined on behalf of the prosecution. In any event, the applicant, who appears in person, makes a limited request. It is submitted that the findings recorded by the learned Sessions Judge in the order dated 31/08/2016, while rejecting the application for bail, should not come in the way of the Sessions

CRMAB/222/2016 Judge, while deciding the trial. The applicant is only asking what is otherwise obvious. It is made clear that the observations and the findings recorded in the order dated 31/08/2016, shall not come in the way of the applicant and the learned Sessions Judge shall not be influenced by the same, while deciding the trial.
