Pursuant to the order dated 15th March, 2019, passed by this Court, the learned prospective Arbitrator Mr. Pramod V. Kamat, has filed his statement of disclosure under Section 11(8) read with Section 12(1) of the Arbitration and Conciliation Act, 1996. The statement of disclosure is taken on record and is accepted.

2. Mr. Pramod V. Kamat, a retired District & Additional Sessions Judge is appointed as sole Arbitrator. The fees and expenses of the learned Arbitrator shall be borne by both the parties equally at the first instance.

3. The Respondents would be at liberty to file the counter claim before the learned Arbitrator. All contentions on merits of the claim and the counter claim are kept open. Parties are directed to convey this order to the learned Arbitrator for information and compliance.

4. The Application for appointment of Arbitrator No.20 of 2018 is disposed of on the aforesaid terms. There shall be no order as to costs.
