Heard Mr. J. Godinho, learned Counsel appearing for the Applicant.

This is an application for bail sought by the applicant as the applicant has been convicted for offence punishable under section 138 of Negotiable Instruments Act and has to undergo imprisonment for a period of one month and pay compensation of Rs.1,40,000/-,. It is pointed out by Mr. Godinho, learned Counsel appearing for the applicant that two instalments of Rs.25,000/- each has been deposited one before the learned JMFC and the other before the Lower Appellate Court and as such a sum of Rs.90,000/- remains to be paid in terms thereof.

3. In the peculiar facts and circumstances of the case, as the Criminal Revision Application has been admitted and the applicant was on bail during the trial. Hence, I pass the following : O R D E R (i) The applicant be released on bail subject to the applicant depositing the balance sum of Rs.90,000/- within two weeks from today.
(ii) The applicant shall also execute a personal bond of Rs.20,000/- to the satisfaction of the learned J.M.F.C., Panaji and one surety of the like amount.
(iii) The applicant shall also remain present in this Court when the matter comes up for final hearing.
