We have taken the affidavit in reply on behalf of Respondent no.2 affirmed by Mr. Rajesh Naik, Chief Town Planner, Town and Country Planning Department, on record. In paragraph 16 of the affidavit, it is stated that the Garbage Management site is not in the property which is the subject matter of the Writ Petition. In the light of the affidavit in reply filed, nothing survives for consideration in the Writ Petition and the Petitioner therefore does not wish to prosecute the petition any further.

3. Writ Petition is disposed of in the light of the affidavit. No costs. 10th July, 2024
