Heard Mr Shivan Desai, learned counsel for the Petitioner in Writ Petition No.90 of 2024 and Mr Chaitanya Padgaonkar, learned counsel for the Petitioner in Writ Petition No.939 of 2023.

The challenge in both these petitions is to the constitutional validity of Rule 134 of the Goa Cooperative Societies (Fourth Amendment) Rules, 2023. 3.

Mr Deep Shirodkar, learned Additional Government Advocate has today placed on record the Gazette Notification containing the Goa Co-operative Societies (Fifth Amendment) Rules, 2024 which substitute the impugned Rule 134.

Accordingly, the challenge in the original petition no longer survives. Learned counsel for the petitioners seek leave to withdraw this petition with liberty to challenge the Goa Co-operative Societies (Fifth Amendment) Rules, 2024 if and when the occasion arises.

Accordingly, leave is granted and both these petitions are disposed of as withdrawn with liberty as prayed for.
