This is an application for condonation of delay of 110 days in filing the present application for setting aside the abatement, for restoration of First Appeal and for bringing the legal representatives of the deceased Appellant on record.

2. Heard the learned counsel for the parties and perused the averments made in the Misc. Civil Application.

3. For the reasons recorded in the Misc. Civil Application, the application is allowed in terms of prayer clauses (a) to (e).

MCA/1022/2018 Amendment to be carried out within two weeks from today. Amended copy of the appeal memo shall be served upon the Respondents' Advocate within one week from the date of service of amended copy of the appeal memo.

4. The Misc. Civil Application is disposed of accordingly. No order as to costs.
