Heard Shri Lobo, the appellant in person and Shri Kalangutkar, the learned Counsel for the respondent.

2. The sole respondent is dead. The present appeal challenges the order passed by the learned Trial Court, refusing to take action against the respondent under Section 340 of Cr.P.C. It is trite that no action under Section 340 of Cr.P.C., which is of criminal nature, can be taken against a dead person.

3. In that view of the matter, nothing survives in the Criminal Appeal, which is disposed of as infructuous.
