Shri.Ramkrishna B. Khanolkar. v. The Principal, Govt. Higher Secondary School, Sanquelim And 2 ORS.,
IN THE HIGH COURT OF BOMBAY AT GOA
WRIT PETITION NO. 898 OF 2015 SHRI.RAMKRISHNA B. KHANOLKAR.
... Petitioner
Versus
THE PRINCIPAL, GOVT. HIGHER SECONDARY SCHOOL, SANQUELIM AND 2 ORS., ... Respondents Ms. Fiona Cardoz, Advocate for the petitioner. Mr. P. Dangui, Additional Govt. Advocate for the respondents. Coram:- F. M. REIS & C. V. BHADANG, JJ.
Date:- 9th December, 2015 P.C.:
Heard Ms. F. Cardoz, learned Counsel appearing for the petitioner and Mr. P. Dangui, learned Additional Govt. Advocate appearing for the respondents.
2 Upon hearing the learned Counsel appearing for the respective parties, it appears that the main grievance of the petitioner is that though, the petitioner has rendered services to the State Government, the salary of the petitioner for the months of September, October and November, 2015 was not released on some unjustifiable grounds. The learned Additional Government Advocate, however, upon instructions, points out that the salary of the petitioner for the months of September to November, 2015 has already been transferred to the account of the petitioner only yesterday. But,
WP/898/2015 however, the learned Counsel appearing for the petitioner vehemently points out that the non-payment of the salary has caused grave hardships to the petitioner and the petitioner was forced to file the present petition to recover his salary and, as such, adequate compensation deserves to be paid to the petitioner. We do not appreciate that the petitioner, who has rendered his services, should not be paid his salary without any justifiable reason.
3. Considering that the salary has already been paid, as pointed out by the Additional Govt. Advocate, we dispose of the above writ petition by directing the respondents to pay a sum of Rs.5,000/- towards costs to the petitioner, within two weeks from today.
4. The petition stands disposed of, accordingly. C. V. BHADANG, J.
F. M. REIS, J.
