The interim relief granted by the learned District Judge on 12.09.2019 and continued by this Court on 22.10.2019 is further continued until the final disposal of Commercial Appeal No.12/2019 subject to the following conditions:- (a) The appellants, in addition to the amount of `25 Crores already deposited, will deposit further amount of `94 Crores in this Court;

2 CA No.222/19 in COMAP No.12/19 (b) Out of the aforesaid, an amount of `50 Crores will be deposited within a period of ten days from today and the balance amount will be deposited on or before 20.12.2019;

(c) In case of any breach, the interim order to stand vacated without any further reference to this Court.

2. The respondents have already withdrawn an amount of `25 Crores against Bank Guarantee of a Nationalized Bank. Accordingly, we grant further liberty to the respondents to withdraw the amount of `94 Crores, again by furnishing a Bank Guarantee of a Nationalized Bank. It is made clear that the bank guarantees should be kept alive until the disposal of the Commercial Appeal No.12/2019 and for a period of Fifteen days thereafter.

3. All concerned to act on the basis of an authenticated copy of this order.

4. Civil Application No.222 of 2019 is disposed of in the aforesaid terms.
