Desai, learned counsel appearing for the petitioner points out that in view of the judgment of the Division Bench of this Court in Criminal Writ Petition No.128/2013 crave leave to withdraw the above Writ Petition with liberty to challenge the impugned order before appropriate forum in accordance with law.

2. Petition stands dismissed as withdrawn with liberty as prayed for.

3. Petitioner is at liberty to file an appropriate application for exclusion of time taken by petitioner in pursuing such remedy and in case such application is filed the learned Sessions Judge shall examine on its own merits in accordance with law. K. L. WADANE, J.
