IN THE HIGH COURT OF BOMBAY AT GOA

Versus
STATE THR. P.P. AND ANR., ... Respondents Mr Ashwin D. Bhobe, Advocate for the Applicant. Mr. S. R. Rivankar, Public Prosecutor for the State-Respondents. Coram:- F. M. REIS, J.
Date:- 21st November, 2016 P.C.
Heard Mr. A. D. Bhobe, learned Counsel appearing for the Applicant and Mr. Rivankar, learned Public Prosecutor appearing for the Respondents.
2. This is an application filed by the Applicant to modify clause (c), (d) and (e) imposed by this Court whilst disposing of the anticipatory bail application by Order dated 13.06.2016.
3. Upon hearing the learned Counsel, it is pointed out by the learned Public Prosecutor appearing for the State-Respondent, that substantial investigation concerning the Applicant is completed and, consequently, he may report to the Investigating Officer as and when directed to remain present.
CRMA/220/2016
4. In such circumstances, clause (c) of the condition imposed in the said Order dated 13.06.2016 stands modified to the effect that the Applicant shall report to the Investigation Officer as and when directed to remain present for the purpose of investigation.
5. With regards to the other two modifications sought, I find that at this stage, to grant a blanket modification as sought by the Applicant, would not be appropriate but, however, as and when the Applicant desires to shift from the local jurisdiction, the Applicant shall inform the concerned Investigation Officer giving the details of such movements. As far as returning the passport is concerned, the Applicant shall file an appropriate application as and when he desires to proceed abroad which shall be examined after hearing the Investigation Officer.
6. With the aforesaid modifications, the application stands disposed of.
